Terms of Service

1. Who we are

Temperates is operated by Enchantra, Inc. ("Temperates," "we," "us"), a Delaware corporation based in the United States. You can reach us at [email protected].

2. Acceptance of these terms

By creating an account, subscribing, or using the Temperates website, app, newsletter, or related services (collectively, the "Services"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Services. You must be at least 18 years old to create an account.

3. Your account

You are responsible for keeping your login credentials secure and for any activity under your account. Notify us promptly if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to other users, our partners, or the Services.

4. Subscriptions, billing, and trials

The Temperates app is offered on a subscription basis. New accounts begin with a free two-week trial. After the trial, the subscription renews automatically at the price shown at checkout (currently $5.99 per month or $59 per year) until you cancel. Prices, plans, and features may change with reasonable notice.

Payments are processed by our payment provider, Stripe. You authorize us and Stripe to charge your selected payment method for each renewal. You can cancel any time from your account or the Stripe customer portal; cancellation stops future renewals and you keep access until the end of the current billing period.

Your first subscription payment comes with a 30-day money-back guarantee: email [email protected] within 30 days of that payment and we will refund it in full, no questions asked. Other subscription fees are non-refundable except where required by law. Referral credits and promotional periods are governed by the terms of the relevant promotion.

5. Acceptable use

You agree not to:

• Use the Services to harass, threaten, or harm others.
• Attempt to access accounts, data, or systems you are not authorized to access.
• Reverse-engineer, scrape, or interfere with the Services.
• Resell, sublicense, or commercially exploit the Services without our written consent.
• Submit unlawful, infringing, or deceptive content.

6. Clair and AI features

The Services include AI-assisted features, including the "Clair" conversational tool (formerly called Muse). Clair is a reflective writing partner — not a medical professional, therapist, addiction specialist, or emergency service. Outputs can be inaccurate, incomplete, or misaligned with your circumstances. Do not rely on Clair for medical, psychological, legal, or financial advice. If you are in crisis or experiencing a medical emergency, contact a qualified professional or local emergency services.

7. Not medical advice

Temperates is a cultural and experiential exploration of drinking less. Our writing, podcasts, tools, and AI features are for informational and reflective purposes only and are not a substitute for medical advice, diagnosis, or treatment. Consult a qualified healthcare provider about any health concern, especially before making changes related to alcohol use.

8. Your content

You retain ownership of the content you submit to the Services (such as journal entries, moments logged, and chat messages with Clair). You grant us a limited, non-exclusive license to host, process, and display that content solely to operate and improve the Services for you. We do not sell your personal content. 9. Our content

All Temperates writing, designs, software, branding, and other materials are owned by Enchantra, Inc. or our licensors and are protected by intellectual-property laws. You may view and use them for your personal, non-commercial use of the Services. Any other use requires our prior written consent.

10. Third-party services

The Services rely on third parties including Supabase (hosting and database), Stripe (payments), Resend (transactional email), and AI model providers. Their terms and privacy practices apply to the portions of the Services they power.

11. Disclaimers

The Services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

12. Limitation of liability

To the maximum extent permitted by law, Enchantra, Inc. and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising from or related to the Services. Our aggregate liability for any claim relating to the Services will not exceed the amount you paid us in the twelve months before the claim arose, or USD 100, whichever is greater.

13. Indemnity

You agree to defend, indemnify, and hold harmless Temperates and Enchantra, Inc., and their respective officers, directors, employees, and agents, from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your use of or access to the Temperates platform, app, or any related content; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any content or data you submit to the platform.

14. Termination

You may stop using the Services at any time and delete your account from the app's Profile screen or by contacting us. We may suspend or terminate access for violations of these Terms or where required by law. Sections that by their nature should survive termination will do so.

15. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will notify subscribers by email or in-app notice. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.

16. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to their personal jurisdiction.
